    From relief to locum

    Hello,
    I work as a relief. I'd like to start to work as a locum. I have to give 3 months notice for my employer,but I found that clause in my contract: 'You will not be entitled to perform work for any other employer until your notice period has expired and your employment terminated'.

    Do people really wait until notice period expires?

    Is it possible for me to register as a locum before my contract expires and start working, when it has expired?

    I think so. But you can't start work as a locum without your employer's permission before you have actually left.

    My guess is that if you told them your plans they would agree, and they might even give you a few bookings. Its usually a mistake to leave a job on bad terms......

    Technically, if you are selling your services as a self-employed Locum, can the company/contractor who is hiring your services be seen as an "Employer"?
    Small, but potentailly significant difference?

    Three months notice is not unusual..in fact it has pretty much become the norm. It is usually negotiable, dependent on individual circumstances. The clause you quote does not stop you acting as a self-employed locum in your own right, as long as in doing so it does not in any way encroach upon, or overlap with your notice period. That is only fair to your current employer, and should be respected.

    Further, many employers (usually multiples) often attempt to impose an 'exclusion zone' in the contract, whereby they attempt to prohibit the employee from working in any capacity as a pharmacist within, say, 3 miles of your current place of employment (even although you are a relief manager)..often for a period of a year after contract termination. You clearly do not have this problem.

    The terms of your contract, therefore, are extremely generous in my opinion. Just start to quietly fill your diary, and don't tread on any toes.

    in short, relief is an employee, usually do the same work for less money compared with a locum.

    locum is self employed pharmacist. both go to different shops, but locums need to sort out their bookings, holidays, insurance, tax claims.....etc

    i would say a relief is a locum employed for less money

    Not always... especially when you were a locum before and a group really wants you in a relief position

    You could also say, a relief is a locum who isn't worried about having to find work, and knows the shops they're going to are fine.

    They will want proof you are a pharmacist currently on the register, also usual ID utility bills etc.
