    It is tricky to give a definitive answer on this as there are different angles on this. As the law stands at present, it would be both the pharmacist and body corporate. At big stores such as the non shoe maker or the pestle and mortar pharmacy, the presence of music etc can sometimes make it difficult to hear certain conversations. Secondly, the corporate is responsible for providing qualified staff.

    The sad thing is that a converastion could be taking place at the other end of the store where the erroneous advice is provided and the pharmacist has no idea of this occurance - but is still liable as s/he is the pharmacist on duty. There have been many cases where MCA/ dispensers have given poor advice just to get the pharmacist in trouble!

    I had this issue at another multiple at two branches I managed during my time with them.
    This was recified by simply disconnecting the speaker nearest the dispensary (with permission of course).

    A few locums commented about how they liked my branch as the music was quieter!

    There was a speaker over the dispensary at the branch of the "non-shoemaker" when I did my pre-reg many years ago. It always made us 'jump' when it burst into life for an important store announcement. Then we had the whole christmas run up with jingles, it really got us into the christmas spirit, which was further enhanced when the manager decided to open the whole store on saturday 27th december 1981. We did around 10 items all day. Imagine a whole store fully staffed with 140 people madly trying to look busy from 0845 until 1730.
