    Angry Smoking delivery driver?

    Hi

    I wanted all if your honest reactions to this. I work in a independent and the staff manager's husband is the driver for us. He smokes whilst in the van doing his deliveries he's been seen by us (staff) and other People, no one has reported him from the patient side but I find this horrific and so do other colleagues. If I approached the manager it's very hard with it being her husband. If I told the owner I don't how he would react but again my life would not be enjoyable at work due to him telling my manager!

    Its disgusting! And it's breaking the law! Our name is on the van delivering to cancer patients surely you don't agree with this?

    Are HGV drivers banned from smoking?. Not sure if moving vehicle is designated as a 'workplace'.
    Just sack him and accept the 'wrongful dismissal claim for damages.
    Next advertise for 'non smoker' and perhaps be accused of discrimination.

    I know of several (more than I would have ever guessed in truth) Pharmacists who also smoke and can be seen outside of their shops, it is an activity that goes on and not one I think to overly worry about IMHO

    Don't know about the UK, but I think you copied Irish law where vehicles, moving or stationary, that are used as part of your employment or self-employment are classed as workplaces and there have been several proceutions of offenders, including taxi-drivers who thought that because they didn't have a boss they could flout the law.
    Every workplace in the Irish Republic must have a notice stating that smoking is forbidden and giving the name of the person responsible for enforcing this. We have an Office of Tobacco Control who will follow up complaints and will proceute as a last resort.

    It is against the law to smoke while driving at work as it is your "place of work". However, "disgusting"? If this is your biggest problem why aren't you celebrating?

    If the van is provided by your employer then they should not smoke in it. It is disgusting having to drive a van where the previous driver has been smoking 20 a day in it. The van should have a no smoking sign in it. The driver could be fined for smoking in the workplace and the company can also be fined for no displaying the correct signage.

    (PS I am a grumpy Ex smoker!)
