It's a professional decision - whatever the pharmacist in charge deems to be in the patients best interests.
Could the pharmacist be in trouble for making a professional decision at odds with the law of the land - yes.
I've made similar decisions in the past - will continue to make them in the future.
I also inform the prescriber (or more usually their answer phone) of my actions.
